‘Give It Away And Pray’ Isn’t A Business Model… But It Doesn’t Mean That ‘Free’ Doesn’t Work

I've been noticing an interesting trend lately. While more folks aren't totally averse to the idea that they need to somehow embrace "free," they're mishandling what they do with "free" and then going on to complain how "free" doesn't work. The basic problem is this: they hear about the importance of "free" and so they give something away for free. But they don't have a business model around the free content. They don't understand the economic forces at work. They just give stuff away and pray... and then whine when nothing happens. As we've pointed out before, no one says that "free" by itself pays the bills. You need to have a more complete strategy than that -- and it involves a lot more than "give it away and pray." It's good that they're at least trying, but if they don't understand the real issues and fail at the experiments, they suddenly come back and claim that "free" isn't the answer, and suddenly rule out all business models involving free. And that is a real recipe for failure.

The latest to head down this road is NY Times columnist David Pogue, who bashes the idea of digital publishing of books by pointing to a long and interesting blog post from author Steven Poole, who did the "give away and pray" option along with a tip jar. It didn't make him much money. That shouldn't be any surprise, because tip jars aren't a real business model. But, because Poole seemed to have an expectation in his mind, he ends up being quite disappointed, noting that 1 out of every 1,750 downloads (0.057%) left some money. What's left implicit here is that that figure is too low. What this really means is that Poole didn't really give away the book for free. He had an expectation that people would magically pay for it. But, that's not a business model. That's not tying the free and infinite good to other scarce goods that will help you make money.

Unfortunately, both Pogue and Poole then use this to bash the entire concept of free-based business models, with Poole getting unnecessarily offensive in his response:
"I'll call it, for short, "the Slashdot argument". It says that books, music, films, software and so on ought to be freely distributed to anyone who wants them, simply because they can be freely distributed. What is the writer or musician to do, though, if she can't earn money from her art? Simple, says the Slashdotter: earn your money playing live (if you're one of those musicians who plays live), or selling T-shirts or merchandise, or providing some other kind of "value-added" service. Many such arguments seem to me to be simple greed disguised in high-falutin' idealism about how "information wants to be free". Perhaps it's not empty pedantry to point out that "information" doesn't want anything in and for itself. The information in which humans traffic is created by humans. And most information-creating humans need to earn dollars or yuan to survive.
While I'm sure there may be some Slashdot-types who may make this argument, it doesn't mean that it's an accurate representation of the more important discussion of these business models. The main problem is his use of "ought," as in people saying things "ought" to be free. It's not that things ought to be free because they can be free -- but that things will be free because that's just basic economics. Price gets driven to marginal cost in a competitive market, and the reason it happens is because others do learn to put in place business models that work, and then if you're the lone holdout, people start to ignore you. Also, I'll note that that Poole brushes off the (indeed, simplistic) business model suggestions as being "high falutin' idealism" but fails to actually try out any real business model.

And then he weakly follows it up by implying that you can't earn money by giving away stuff for free. But, again, he's blaming the wrong thing: he's blaming free for his own failure to use a real business model where the free offering was closely tied to additional scarcity he could sell. He continues, getting even more insulting as he goes:
In any case, I think the Slashdot argument can actually be disposed of rapidly with one rhetorical question, as follows.

Oh Mr Freetard, you work as a programmer, do you? How interesting. So do you perform all your corporate programming duties for free, and earn your keep by selling personally branded mousemats on the side?

Didn't think so.
This misleading and mistargeted argument has been debunked so many times, it's disappointing to see both Poole and Pogue repeat it. But, since it needs a response, let's do it again: you give away the infinite goods, not the scarce goods. Your time is a scarce good. No one is saying that everything needs to be free -- they're saying that infinite goods will be free, because of it's very nature in economics. In fact, Poole's argument is particularly weak when it comes to programmers, because most programmers don't earn any kind of royalties for the software they write. They are paid a salary, for their time -- but not for the software itself (which is an infinite good). And, I won't even get into the number of programmers who work on open source projects for free... or the fact that Poole is blogging for free...

Again, Poole and Pogue are so focused on free, that they fail to distinguish between infinite and scarce goods or the business models involved in what's going on. Poole then weakly dismisses the Radiohead experiment:
Perhaps I could have tried distributing Trigger Happy the Radiohead way, making sure you had to pay a minimum to get the goods. Would I still have attracted 30,000 readers like that? I doubt it. The sublime In Rainbows seems to have been a nice little earner for Radiohead, but that's because they're Radiohead -- and they became Radiohead through the nasty old music-industry business model. So did Nine Inch Nails, whose recent internet release of (the excellent) Ghosts was very clever -- the first nine songs of a triple album for free in compressed mp3; the whole thing in a lossless format for $5. But if there's been a comparable success by a band that hasn't already gained its cultural capital and name-recognition through the evils of copyright and corporate promotion, I'd like to know about it.
Poole and Pogue (who quotes the same snippet) both miss the fact that in both cases described above, the bands in question didn't "give away and pray," but both put together real strategic business models that were focused on using the infinite goods (the music) to sell more scarce goods. In the case of Radiohead (despite some claims to the contrary) at the same time Radiohead announced the downloads it also told fans that it would be selling a beautiful "discbox" for the album as well. This was a very valuable scarce good -- that the free music made a lot more valuable by increasing the demand for it. As for Nine Inch Nails, Trent Reznor offered a tiered system of scarce goods that were all made more valuable by the availability of the music -- proven by the fact that Reznor quickly sold out of his limited edition deluxe offering.

And I still chuckle about the argument that these models "only work for big bands." That's because a few years ago, when we pointed out how this worked for some small up-and-coming bands, people would whine "but that only works for small bands -- big bands would be screwed!" The model, when well designed works for small bands just as well as big bands. No, it might not turn around millions in a week, but it can certainly help an artist make a living. Witness the case of Maria Schneider, who ended up making a Grammy-winning album using some the concepts discussed around these parts. And, of course, we've worked out the details of the type of business model that an up-and-coming band could use to embrace these concepts to grow.

So, it's nice to see someone at least willing to explore the concept of free without shutting out the possibility. But free alone isn't a business model. And it's wrong to blame free for the lack of establishing a complete business model. Just because "give it away and pray" isn't a workable business model, that doesn't mean that there aren't business models that do work. Hopefully, Poole and Pogue will eventually recognize that they're dismissing the wrong thing. They shouldn't be complaining about free (or making misleading accusations about those who simply recognize the economic forces at work) -- they should be complaining about a failure to put in place a real business model to take advantage of what will be free.

My son and I love watching Yo Gabba Gabba! on teevee. Our favorite episode is Sleep because it features two particularly delightful songs. The first is a lovely tune called Bedtime Lullaby by Mark Kozelek of Red House Painters and Sun Kil Moon. The animation is by Lippy. In the same episode is a fun performance of "Pajama Party" by teenage indie pop duo Smoosh. Viacom seems to have insisted YouTube yank the Pajama Party video, but Bedtime Lullaby is still available. Apple to Rule the Digital Home by 2013?

Stony Stevenson writes to tell us that a new study from Forrester Research is taking a crack at what seems to have become a hobby for so many, predicting Apple's market strategy. Specifically, Forrester is predicting that Apple will become the 'hub of the digital home by 2013'. "Forrester predicts that Apple will offer eight key products and services to connect PCs and digital content to the TV-stereo infrastructure in consumers' homes. A 're-engineered' Apple Store will expand into in-home installation services to deliver what Forrester describes as a 'fully integrated digital experience.'"

Debunking The Faulty Premises Of The Pirate Bay-Criminalization Treaty

The entertainment industry's lobbying efforts for stronger intellectual property laws is incredibly sophisticated. The more you follow their efforts, the more impressive you realize they are. Every time one aspect is somehow blocked, another almost immediately pops up somewhere else that has been simmering below the surface for months. While many more are aware of efforts to directly lobby politicians to change copyright laws, what gets less attention is the work that's put into various "international trade" treaties. Two years ago we wrote about how this was a favorite tactic of the copyright lobby. They basically write up a treaty for the government, who then signs the treaty with a bunch of countries, without anyone realizing all of the details. Then the copyright lobby starts using the crutch that all of the countries involved have to strengthen their copyright laws in order to "comply with our international treaty obligations."

Kevin Stapp writes in to let us know about the latest such proposed treaty that has been leaked to Wikileaks. The document is (not surprisingly) a wishlist for the entertainment industry and, as Wikileaks notes, it was distributed only to pro-stronger-copyright lobbyists for comment, and not to any consumer rights groups or those who recognize that stronger copyright can be quite damaging. Slashdot talks about what Wikileaks calls the "Pirate Bay Killer" clause that would force countries to criminalize significant facilitation of infringement, even if it's not for profit. Why countries should be criminalizing what is, in actuality, a business model question is never explained.

However, there are many more problems with the paper, including the fact that many of its most basic assumptions are either untrue or unproven. When you base an entire international trade treaty on questionable (or outright incorrect) assumptions, bad things will result. It starts out by noting:
The proliferation of infringements of intellectual property rights ("IPR") particularly in the context of counterfeiting and piracy poises an ever-increasing threat to the sustainable development of the world economy
Except that two recent government studies have shown no such thing. Both the GAO and the OECD have noted that both the magnitude and the impact of counterfeiting is greatly exaggerated by lobbyists. The paper goes on:
The consequences of such IPR infringements includes (1) depriving legitimate businesses and their workers of income; (2) discouraging innovation and creativity; (3) threatens consumer health and safety; (4) providing an easy source of revenue for organized crime; and (5) loss of tax revenue.
Let's go through those one by one. On point (1), this is simply untrue. As we've pointed out in the past, there's no such thing as "depriving" someone else of income -- otherwise convincing someone to go to a pizza shop instead of a deli would be considered a crime (you've "deprived" the deli of income). Where money goes is a marketing issue, not a legal one. If companies are having trouble convincing people to pay them for their products, that's their business model problem. Nothing is being taken from them.

On point (2), this is also simply untrue. Study after study have shown no corresponding decrease in innovation or creativity when intellectual property laws are weakened (or even removed entirely). In this day and age when so much creativity takes place outside of traditional intellectual property realms, it seems ridiculous to even suggest that creativity is somehow impacted.

The closest the paper comes to having a reasonable point is on point (3), but that really only applies in very narrowly defined cases (specifically involving dangerous counterfeit products that may not be safe). Yet, that's an extremely narrow area, and can be dealt with via other means, including anti-fraud law. And, when dealing with international trade issue, it seems like the sort of thing that ought to be handled by customs, rather than with some big intellectual property treaty.

Point (4) is a favorite claim by the industry, but it's never been backed up with any significant evidence. I'm sure there are some organized crime groups that traffic in counterfeit products -- but again, that can and should be dealt with by other laws. Strengthening intellectual property laws to combat organized crime is a misuse of intellectual property laws.

The question of tax revenue (5) is also a favorite of the industry that relies on only counting the ripple effects in one direction. That is, it assumes that the lost tax dollars come from things like the sales tax on software products that would be bought, but fails to count the economic growth and additional tax from businesses who are able to more rapidly grow the economy through the use of cheaper software.

So the entire underpinning for the argument in favor of these "trade agreements" is a house of cards (if that much). But for those who aren't all that familiar with the space (or whose political campaigns are funded by the entertainment industry), these claims are all taken as a given. That should be seen as a serious problem.

Closing the Cover on Microsoft Book Scanning

Book search in particular has had quite a bit of coverage, and often seemed like a race with Google. The Live blog says 'we are winding down our digitization initiatives, including our library scanning and our in-copyright book programs. We recognize that this decision comes as disappointing news to our partners, the publishing and academic communities, and Live Search users [...] this past Wednesday we announced our strategy to focus on verticals with high commercial intent, such as travel, and offer users cash back on their purchases from our advertisers"."

Monitoring Twitter’s down-ness

A picture named parakeet.gifI've been thinking about writing an app that would check Twitter every ten minutes to see if it's down or up, and track it over time. Today, being a particularly bad day for Twitter, I had a bit of time to actually write the app.

Inside Craigslist’s Increasingly Complicated Battle Against Spammers

John Nagle writes in with a fascinating dissection of the ongoing battle between Craigslist and spammers. The back and forth nature of this battle is fascinating -- and somewhat disturbing when you realize the lengths to which spammers will go to get spam onto Craigslist, and the extent to which an entire ecosystem of scammers and software providers seems to have been built up around this effort:

"Spam on Craigslist has been a minor nuisance for years. Not any more. This year, the spammers started winning and are taking over Craigslist. Here's how they did it. Craigslist tries to stop spamming by checking for duplicate submissions. They check for excessive posts from a single IP address. They require users to register with a valid E-mail address. They added a CAPTCHA to stop automated posting tools. And users can flag postings they recognize as spam.

Several commercial products are now available to overcome those little obstacles to bulk posting. A tool called CL Auto Posting Tool is one such product. It not only posts to Craigslist automatically, it has built-in strategies to overcome each Craigslist anti-spam mechanism.

Random text is added to each spam message to fool Craigslist's duplicate message detector. IP proxy sites are used to post from a wide range of IP addresses. E-mail addresses for reply are Gmail accounts conveniently created by Jiffy Gmail Creator ("Who Else Wants to Create Unlimited Gmail Accounts in Seconds Flat Without Breaking a Sweat?") An OCR system reads the obscured text in the CAPTCHA. Automatic monitoring detects when a posting has been flagged as spam and reposts it.

CL Auto Poster isn't the only such tool. Other desktop software products are AdBomber and Ad Master. For spammers preferring a service-oriented approach, there's ItsYourPost.

With these power tools, the defenses of Craigslist have been overrun. Some categories on Craigslist have become over 90% spam. The personals sections were the first to go, then the services categories, and more recently, the job postings.

Craigslist is fighting back. Its latest gimmick is phone verification. Posting in some categories now requires a callback phone call, with a password sent to the user either by voice or as an SMS message. Only one account is allowed per phone number. Spammers reacted by using VoIP numbers. Craigslist blocked those. Spammers tried using number-portability services like Grand Central and Tossable Digits. Craigslist blocked those. Spammers tried using their own free ringtone sites to get many users to accept the Craigslist verification call, then type in the password from the voice message. Craigslist hasn't countered that trick yet.

Much of the back and forth battle can be followed in various forums.

It's not clear yet who will win. Craigslist may find something that works. If it doesn't, however, it could be toast for the success story of Craigslist."

Her political career is over

This time Hillary Clinton has gone too far.

Strike 1. Positioning Barack Obama as the black candidate after the South Carolina primary.

Strike 2. Refusing to say Obama is Christian, not Muslim.

Strike 3. Saying white voters go with her, in desperation, after the Indiana and North Carolina primaries.

Strike 4. Suggesting she should stay in the race because Bobby Kennedy was assassinated in June in 1968.

Too much benefit of the doubt. Bringing assassination into political discourse as an "issue" is too much.

Hillary Clinton is a sophisticated, calculating politician. She doesn't make accidental statements, and has in no way earned the benefit of the doubt. Her explanation is a non-explanation. Her retraction was not a retraction, and she was nowhere in the neighborhood of an apology

Screwing around with life and death is over the top.

Earlier today I posted on Twitter that it was inevitable that she would be on the ticket with Obama. Once again I forgot how awful this person is. It won't happen again.

How Much Does The Job Of Corporate Email Reader/Snooper Pay?

It's no secret that plenty of big firms do track emails that are being sent by employees, to be able to look for leaks or spot questionable email behavior. And, indeed, a new study finds that 41% of the largest companies surveyed do employ people to analyze outbound emails, though that could just be looking over stats for anything suspicious. However, the report also notes that 22% of the companies employ people for whom this is their primary job -- which suggests that at least some of those are basically sitting there all day scanning and reading the email of employees, looking for anything questionable. This seems fairly extreme. While I can understand the idea of having a system to go back and spot questionable emails if an investigation requires it, having full time staff scanning emails seems to be a clear indication that these companies simply don't trust their employees. I recognize in a large corporation that you can't trust all your employees, but that doesn't seem like a good reason to spy on all of them. Do these companies also record all of their phone calls and listen to them? Or track what all the employees do when they leave the office?

Blogger Incites Outcry Over Twitter Harassment

CNet is reporting that one blogger has started an outcry about harassment as it applies to Twitter. While their written stance appears to support the safeguarding of abuse, Twitter appears to be waffling on the issue when it comes to the hard line of enforcement. "The final response to Waldman's complaint from Twitter co-founder Biz Stone asserted that "Twitter is a communication utility, not a mediator of content," and that "Twitter recognizes that it is not skilled at judging content disputes between individuals. Determining the line between update and insult is not something that Twitter, nor a crowd, would do well. Stone added that Twitter's team would continue talking about which situations were appropriate for account banning."

Microsoft Gets Out Of Book Search, But Hands Tools Over To Libraries

In a somewhat unexpected move, Microsoft has announced that it's abandoning its book scanning project. While Google's book scanning project has received a lot more attention (and lawsuits) for the way it's set up, Yahoo and Microsoft teamed up with the Internet Archive to try to do something similar, though focusing mostly on public domain works and other books where they have the publishers' permission. Microsoft doesn't give an entirely lucid explanation for giving up the project, but it is handing over the scanning systems it put together to its various library partners and hoping they'll continue scanning on their own, saying:
"Based on our experience, we foresee that the best way for a search engine to make book content available will be by crawling content repositories created by book publishers and libraries."
In some ways, this is a stunning quote coming from Microsoft, admitting that a publicly available repository, created by others an which anyone can index, is better than a proprietary and controlled solution. The company is probably correct that it's better to have the content be available to any search engine rather than stuck in a silo, but there's probably much more behind this reasoning -- such as the fact that Google's book scanning project seems to be gaining a lot more traction, perhaps because Google is doing deals with libraries to scan their books for free, while the Open Content Alliance (which Microsoft's project was a part of) charges money to libraries.
